These Terms of Service (“Terms”) govern your access to and use of CFOly.ai (the “Service”), operated by Profit Matters, located at 3960 FM2181 Ste 120, Hickory Creek, TX 75065, United States. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility

Users must be at least sixteen (16) years of age to access or use the Service. By using the Service, you represent and warrant that you have the legal authority to bind yourself or your organization to these Terms.

2. Account Registration

To use the Service, you must create an account and provide accurate and complete information, including your full name, username, email address, password, and business information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Subscription and Payments

CFOly.ai offers subscription plans billed monthly or annually. Payment obligations are non-refundable except as required by law. We reserve the right to change subscription fees upon notice. You are responsible for any applicable taxes associated with your subscription. All payments are processed securely through Stripe.

4. User Data and QuickBooks Integration

You may connect your QuickBooks account to CFOly.ai to import financial data. All QuickBooks data is processed in real time and is not stored long-term on our servers. You are solely responsible for the accuracy and completeness of the data you provide. By using the Service, you consent to the processing of your data in accordance with our Privacy Policy.

5. AI Chat

The AI assistant provides insights and analysis based on the information you provide. The responses generated by the AI are for informational purposes only and do not constitute professional financial advice. You are responsible for verifying any decisions made based on AI-generated information.

6. Acceptable Use

You agree not to use the Service in any manner that violates applicable laws or regulations, interferes with the Service or its servers, attempts unauthorized access to data, or engages in fraudulent or malicious activity.

7. Intellectual Property

All content, design, software, and branding associated with CFOly.ai are the property of Profit Matters or its licensors. You may not copy, modify, distribute, or create derivative works from any part of the Service without explicit permission. You retain ownership of your own business data submitted to the platform.

8. Disclaimers

The Service is provided “as is” and “as available” without any warranties of any kind, either express or implied. While we strive to maintain accurate and reliable functionality, we do not guarantee the accuracy, reliability, or uptime of the Service. Use of the Service is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Profit Matters shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Service. Our total liability to you for any claim arising from the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate your account for violations of these Terms or for legal compliance reasons. You may cancel your subscription at any time through your account settings. Upon termination, your data will be retained or deleted in accordance with our Privacy Policy.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Texas. By using the Service, you consent to the jurisdiction of these courts.
